Dear Mr. Thompson,                                                                                                                

We wish to advise you that Allstate Insurance Company has investigated your claim under policy number 216719784 with respect to the fire which occurred on or about November 26, 1991 at 4005 N.E. 17th, Amarillo, TX.

The policy specifically states in PART II, BASIC CONDITIONS, under Requirements in Case of Loss or Occurrence, "Section I-Property Section - If loss occurs under Section I, the Insured shall:

if requested by the Company, submit to examination under oath and subscribe the same;

produce all pertinent records for the Company's examination as often as may be reasonably required at such reasonable time and place as may be designated by the Company or its representative and permit extracts and copies thereof to be made.

As you know, Allstate Insurance Company has requested your wife to submit to an examination under oath. On each occasion, she has refused to give an examination under oath. Further, you have failed to cooperate with the investigation in providing the information and documents requested by Allstate Insurance Company

The policy also specifically states in PART II, BASIC CONDITIONS, under Concealment Fraud, "This entire policy shall be void if, whether before or after a loss, the Insured has willfully concealed or misrepresented any material fact or circumstance concerning this insurance, or the subject thereof, or the interest of the Insured therein, or in case of any fraud or false swearing by the Insured relating thereto."

Based on the evidence Allstate Insurance Company has gathered through its investigation, the determination that this fire was not accidental, and your refusal to fully cooperate with our investigation, Allstate Insurance Company has no choice but to deny your claim under policy number 216719784 arising from the fire which occurred on or about November 26, 1991.

Further, Allstate Insurance Company expressly reserves any rights or defenses which they have, may have had in the past or may have in the future under the above captioned policy or under any applicable law regardless of whether such rights or defenses have been specifically referred to in this letter or our previous letters.

Allstate even states in their letter that the policy states, "the Insureds are required to submit to Examinations Under Oath". They denied my claim because someone other than an Insured, would not submit to their Examination Under Oath. My ex-wife and myself were the Insureds. I submitted to their Examination Under Oath and did absolutely everything they asked and demanded of me. My ex-wife (the other Insured) was never questioned, or asked to submit to their Examination Under Oath. My new wife, at the time, was not an Insured and had nothing to do with the property, and would not submit to their Examination Under Oath. Thus, the denial! Allstate was notified of this on numerous occasions, but they didn't care, even though they knew they were wrong. This shows just how corrupt these people are!
