          COMES NOW, Donald L. Thompson, Plaintiff, and asks this court to take Judicial Notice of Defendants Declaration of Anticipation of Litigation date as being the date Plaintiff filed his claim. This was stated by Defendants attorney in court yesterday, April 28,1998, at our motion hearings, when Plaintiff verbally requested same.
